SPECIFIC TERMS
AND CONDITIONS OF USE
(HAGER PILOT, application reserved for trained professionals)

THE SERVICE IS PROVIDED BY HAGER (as defined below). ACCESS TO THE ‘HAGER PILOT’ APPLICATION (HEREINAFTER THE ‘SERVICE’) IS POSSIBLE SUBJECT TO COMPLIANCE BY THE USER (AS DEFINED BELOW) WITH THE SPECIFIC CONDITIONS OF USE SET OUT BELOW, OF WHICH THE USER IS AWARE AT THE TIME OF CONNECTION TO THE SERVICE.
USE OF THE SERVICE IMPLIES ACCEPTANCE OF THE TERMS OF USE ON FIRST CONNECTION. WE RECOMMEND THAT YOU READ THE TERMS OF USE BEFORE EACH USE OF THE SERVICE, AS THEY MAY BE AMENDED AT ANY TIME WITHOUT NOTICE.
THE USER THEREFORE DECLARES THAT HE ACCEPTS THESE CONDITIONS OF USE.
The ‘Hager Pilot’ application (hereinafter referred to as the ‘Hager Pilot App’) is an application for Mobiles and Tablets, running under iOS and Android, as well as Computers running under Windows and MacOS.
CONTENT OF THE TERMS AND CONDITIONS OF USE
These Conditions constitute the rules of use of the Hager Pilot App and form a contract between the user of the Hager Pilot App and Hager .
1. DEFINITIONS
Within these Terms the terms used below have the following meanings, whether they are used in the singular or plural:
Cloud : the place where computer resources and data are stored and can be accessed remotely via a communications network ;
Data Protection Legislation : means, as the case may be, the legislation applicable to one or other of the Parties :
1. the General Data Protection Regulation of 27 April 2016 ;
2. the Data Protection Act 2018 ;
3. the Privacy and Electronic Communications (EC Directive) Regulations 2003;
4. the Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019 ;
5. any other applicable law relating to the Processing, privacy and/or use of Personal Data, as applicable to either party ;
6. any laws which implement any such laws; and,
7. any laws that replace, extend, re-enact, consolidate or amend any of the foregoing.
End user : refers to the User's customer;
Force Majeure Event : ”: any event arising that is beyond the reasonable control of the affected party (including any industrial dispute affecting any third party, governmental regulations, endemic, pandemic, fire, flood, inclement weather, disaster, civil riot or war).
Hager Group means Hager SE, Zum Gunterstal, 66440 Blieskastel, Germany, and any entity directly or indirectly controlled by Hager SE and the term ‘controlled’ means that Hager holds fifty percent (50%) or more of the voting shares or equity interests or the power to elect the board of directors.
Hager Pilot App or Application : means both (i) the "Hager Pilot App" software application for Mobiles and Tablets, which can be downloaded from the Apple and Google stores and made available by HAGER and (ii) the "Hager Services";
Hager refers to the company offering the service(s) in your country (see appendix 1 - country of distribution & support contact).
Country of Distribution means each country in which a Hager Group company distributes the Hager Pilot App.
Hager Content : the content including all Intellectual Property Rights (other than User Generated Content) present on the Application for the purpose of using the Services or facilitating the Services (which may or may not include Personal Data).
Services : refers to the services provided by HAGER via the HAGER Pilot App as part of the use of the software application described in more detail in clause 5 of these Terms.
Mobile : refers to the smartphones used to access applications via an internet connection ;
myHager : refers to website published by HAGER SAS which a User who has created a personal account can use to access a range of services ;
Personal Data : means Personal Data as defined in the Data Protection Legislation;
Smart device : means the device that controls or other device to be activated, configured or maintained by Hager Pilot App ;
Tablet : refers to the touchscreens used to access applications via an internet connection ;
User : refers to any qualified electrical professional who accesses and uses the Hager Pilot App ;
User content : means all personal details (including without limitation text, graphics, images, audio material, video material, scripts, software and files) that the User upload, embed or otherwise display and/or store on the Hager Pilot App for storage or publication on, processing by, or transmission via Hager Pilot App (which may or may not include Personal Data).
2. USE OF THE HAGER PILOT APPLICATION
Use of the Service may require the User to accept other general or specific Terms and Conditions.
In order to use the Services, the User must accept without reservation these Terms of Use relating to the provision of the Service and the licence conditions (‘end user licence’). If The User does not accept these Terms in whole or in part, access to the Service will not be granted.
The contracts concluded between the User and Hager (general conditions, specific conditions and end-user licence) govern the use of the Services and the software products essential to their realisation. If the User clicks on ‘I accept’, he/she accepts these conditions unreservedly and for the entire duration of access to the Services.
THE SERVICE IS INTENDED FOR PROFESSIONAL CUSTOMERS WHO USE HAGER PILOT FOR PROFESSIONAL PURPOSES ONLY.
The Terms may be amended at any time, and the User must always ensure that he/she refers to the current version as published on the Application.
These Terms apply to the use of the Hager Pilot App. They do not alter the terms of any other express written agreement between Hager and the User.
The User declares and guarantees :
- Be an electrical professional and use Hager Pilot App for professional purposes
- That he/she is over 18 years of age and is legally able to accept these Terms. If he/she is using Hager Pilot App on behalf of an entity, he/she represents and warrants that he/she is authorized to accept these Terms on behalf of such entity, and that such entity agrees to indemnify Hager in the event of any breach of these Terms.
The user indemnifies Hager against any claim arising from a breach of this warranty.

4. SERVICES
Hager Pilot App only offers services to electrical professionals who use Hager Pilot App for professional purposes, under their own responsibility, in particular with regard to applicable standards and legislation.
Hager undertakes to ensure that the Hager Services are performed with reasonable care. No warranty shall apply in the event of non-conformity caused by use contrary to these Terms, or modification or alteration of the Services by a third party. If the Services do not comply with the aforementioned undertaking, Hager will use reasonable commercial efforts that it deems necessary to correct this non-compliance. This correction constitutes the sole and exclusive remedy available to the User in the event of a breach of the undertaking set out in this paragraph.
These terms do not prevent Hager from entering into similar terms with third parties or from independently developing, using, selling or licensing services similar to those provided here.
Availability and security of the Application and Services :
4.1. Hager provides the Hager Application and Services in accordance with these Terms.
4.2. The Services are provided on an ‘as is’ and ‘as available’ basis. Hager makes no representation or warranty, express or implied, that the Hager Pilot application and Services:
- Will always be available or uninterrupted ;
- Will be error-free, accurate, complete and up-to-date;
- Or will be secure or free of bugs or viruses.
4.3. Hager shall not be liable if, for any reason, the Hager Pilot App and Services are unavailable at any time or for any period.
4.4. Hager undertakes only to use commercially reasonable efforts to make the Hager Pilot Application and the Services available to the User twenty-four (24) hours a day, seven (7) days a week, except in the case of:
- Planned maintenance carried out outside Hager's opening hours; and,
- Unscheduled emergency maintenance that may be required.
4.5. For technical or other assistance related to the Hager Pilot application and Hager Services, please contact Hager at the address listed in Appendix 1 - Country of distribution & support contact.
5. USING THE APPLICATION
IMPORTANT NOTE TO USERS :
Hager Pilot App is a tool designed to facilitate certain tasks undertaken by Users as part of their professional services only. It allows a User to access, program, control and maintain a Smart Device. The User is obliged to carry out the necessary checks to ensure that the Smart Device complies with the applicable standards and regulations. The User is solely and exclusively responsible for his use of the Application and the Smart Device, for the Content and/or Personal Data he enters therein, and for ensuring that any installations and/or settings he makes comply with applicable legal standards and regulations.
To use the Application, the User must download the Application from the Apple or Google shops, and must be connected to the Internet.
To access the Hager Pilot App which provides access to Hager Services, the User must either create a personal account on myHager or log into its account, if such option exists. Creating a personal myHager account requires: the User's acceptance of the Privacy Policy on the myHager portal, and the terms and conditions of use specific to the myHager website. To create a myHager account, the User is required to enter Personal Data.
Third Party Features :
5.1. Saving to Cloud gives the User the option to back up its projects to Cloud, provided that the User is logged into its personal myHager account. The data and projects are hosted on the Cloud provided by Microsoft Azure, in data centres located in Europe.
Sharing Features :
5.2. The User is solely and exclusively liable for anything they share on third party sites, the User warrants, accepts and undertakes that this is not a secure way to share data, and does so at its own risk under its exclusive and sole liability. Consequently, Hager cannot be held liable under any circumstances whatsoever for the consequences of the User sharing in this way.
6. NO WARRANTIES
The User understands, acknowledges and accepts:
6.1. Hager does not give any warranties either express or implied in respect of the Hager Pilot App contents or/and is used or/ how any documents or content is generated.
6.2. Hager specifically does NOT warrant that :
The content and/or documents generated via the Hager Pilot App will meet the User’s expectations and requirements or produce the results they want;
The Hager Pilot App will operate without any interruption or operational errors, or in a secure manner; and
The quality of the service, specifically the results obtained via the Hager Pilot App, will meet the User’s expectations.
7. UPDATES AND MODIFICATIONS
7.1. Updates:
The software product is maintained by Hager and modified or updated over time as required. Hager carries out these updates in the form of error corrections, patches, extended functions and new versions by means of standard procedures in the operating system of the Smart Home Device or via the Application platform. To the extent permitted by law, the User has no specific right to software updates.
Hager declines all responsibility for any errors in the service attributable to the User not having downloaded and/or installed the available updates, or not having done so in full, as well as in the event of non-compliance with the instructions provided. It is the User's responsibility to follow the instructions to ensure the correct installation of the update and consequently the correct operation of the Smart Home Device.
7.2. Amendments/Changes:
7.2.1. Hager reserves the right to amend the specification of the Services on Hager Pilot App if this is required by any applicable statutory or regulatory requirement or if Hager believes that the change does not materially affect the nature or quality of the Services or if minor technical improvements or adjustments are necessary to address security and functionality. Please check the Hager Pilot App regularly for such updates. Major changes to the specifications to ensure a better customer experience and accuracy will be communicated to the User.
7.2.2. Hager may amend these Terms at any time, to reflect any changes to the App and/or Services, the needs of its customers and its business priorities. Hager will attempt as far as possible to give reasonable notice before implementing any such changes and will publish the updated Terms on the Hager Pilot App. The User undertakes to check these Terms regularly and at least each time he uses the App to ensure that he accepts the current Terms. The User is deemed to have accepted any modification of the Conditions if he continues to access or use Hager Pilot App.
Hager may also update and modify the Application from time to time at its sole discretion.
8. ACCESS TO THE APPLICATION AND OPERATION
8.1. Disclaimer regarding the content of the App:
The material and information published on Hager Pilot App is not advice and should not be relied upon as such. All materials and information are for advertising and information purposes only. Hager accepts no liability arising from reliance on this information by a professional customer. Hager does not warrant that the content of the Hager Pilot App will be free from errors, Trojan horses, viruses, bugs, etc., nor does Hager make any representations regarding the quality, accuracy or completeness of the content available on the App.
8.2. Security and use of Hager Pilot App:
The User is responsible for maintaining appropriate software on their computer or device to protect against, for example, errors, bugs, Trojan horses or viruses.
8.3. Undertaking by the User :
The User represents and warrants that he/she will comply with all applicable laws and regulations, including, without limitation, those relating to the Internet, data, electronic communications, privacy and data transmission applicable in the Country of Distribution of the Hager Pilot App.
8.4. Availability, Interruptions or Withdrawal:
Hager will use reasonable endeavours to keep the system available and to maintain the functionality of the system at all times. Hager reserves the right to interrupt the operation of the Application at any time, with or without notice, in particular in order to carry out corrective and ongoing maintenance, or to improve the content or appearance. Insofar as possible, Hager will inform Users prior to any corrective and ongoing maintenance operation. The User accepts and acknowledges that the Application may be interrupted for reasons beyond Hager's control and that Hager cannot guarantee uninterrupted access to the Application.
Hager shall not be liable to the User or any other person for any loss or damage arising from the unavailability, interruption or malfunction of the Hager Pilot App and/or the Services in any circumstances, howsoever caused.
Hager reserves the exclusive right to delete or modify all or part of the Services accessible to Users or the functionalities of the Application, or to withdraw the Application altogether, and may under no circumstances be held liable by its Users for doing so.
Users are invited to inform Hager of any technical problems they encounter when browsing and/or using the Application by sending a description of the problem encountered to the e-mail address given in Appendix 1 - country of distribution & support contact.
8.5. Logout at end of session :
It is necessary to disconnect from the Hager Pilot App at the end of each use in order to avoid any unauthorised transactions or use that may result, for which Hager cannot be held responsible under any circumstances.
8.6. Reliability :
The content of the Application is provided for general information purposes only. It is not intended to constitute advice on which the User should rely. Although Hager uses reasonable efforts to update the information on the Application, Hager makes no representations, warranties or assurances, express or implied, that the content of the Application is accurate, complete or current.
8.7. Registration:
The User shall create an account by completing and submitting the registration form on the Application and clicking on the verification link in the email. Your account details must not attempt to mislead or impersonate any other company or person.
8.8. Passwords and account protection :
To create an account on the Application, you need to enter a user name and password.
The User is responsible for accessing the Hager Pilot App using their internet connection, even if they authorise access to another person. The User remains responsible for the safety and security of any passwords and login details relating to the Hager Pilot App and any account for which they have registered. In order to protect your account from unauthorised access, Hager suggests that you keep your username and password secure and never disclose them to anyone. Hager also recommends logging out of the account at the end of each session. It is imperative to close the browser window when the User has finished his/her session, especially if he/she is sharing a computer with someone else or if he/she is using a computer in a public place.
8.9. Unauthorised access :
If the User suspects that unauthorised access has been made to their account, they must notify Hager immediately at the address set out in clause 3 above. Hager will investigate any suspicious activity. Hager reserves the right, and where appropriate at your request, to deactivate or block the Account and any User ID or password at any time where it is suspected that unauthorised access has been made to it or for any other reasonable reason at our discretion.
8.10. Restriction of access :
Hager reserves the right to restrict access to the Hager Pilot App or any part thereof. Access to restricted areas of the Hager Pilot App may be subject to registration and other conditions. If Hager grants permission to access a restricted area of the Hager Pilot App (such as the part that only Registered Users can see), Hager may withdraw such permission at any time (including in the event of a breach of all or part of these Terms). Hager may, for example, suspend access to the Hager Pilot App during server maintenance or when Hager updates the Hager Pilot App. The user must not circumvent or attempt to circumvent any measures restricting access to the Hager Pilot App, for example by creating a new user name/account.
8.11. Suspension or deletion of account by Hager :
Hager reserves the right, at its sole discretion, to:
- amend the Account details ;
- temporarily suspend the Account; and/or delete the Account at any time in accordance with clause 10.4 below or for any other reason.
8.12. Account deletion by the User:
Users may delete their account at any time by accessing the myHager account page.
9. USE OF THE APPLICATION
9.1. Downloading:
The User must have downloaded ‘Hager Pilot’ available on the Apple and Google shops.
9.2. Commitments :
When using the Application, the User warrants and undertakes to comply with these Conditions at all times.
9.3. Updates:
Hager recommends updating to the latest software version of the Application. This update is done at the sole discretion and under the responsibility of the User. Under no circumstances should the User encourage, request or allow his customer to use the Application and carry out such an update on his own.
9.4. Restrictions :
The User may not:
- Use Hager Pilot App or the content for any use other than that intended. It is reminded that the site and/or the Application is mainly intended for people who are in the Country of Distribution at the time of use. Hager does not guarantee that the content of the Application is available or appropriate in other countries. Hager reserves the right to limit the availability of the Application to a given geographical area.
- Print, download, copy, adapt or retransmit all or part of the Hager Pilot App or the Content, except for professional use of the Hager Pilot App under the User's responsibility. This means that the User may print a copy for his/her professional use, if he/she deems it necessary. Hager's authorship of the Content must always be acknowledged;
- Use data mining methods, robots or similar data collection or extraction methods;
- Manipulate or display Hager Pilot App or its content using framing or similar technology;
- Registering, subscribing, unsubscribing or attempting to register, subscribe or unsubscribe from a party if the User is not expressly authorised by that party to do so or attempting to impersonate a party in doing so.;
- Use Hager Pilot App or its content other than for its intended purpose or in violation of any applicable law, including, without limitation, copyright and trademark laws, laws of privacy and publicity, and communications regulations and statutes.;
- Use Hager Pilot App to defame, abuse, harass, stalk, threaten or otherwise violate any rights of others, including, without limitation, rights of privacy or publicity of others, impersonate any person or entity, falsely state or otherwise misrepresent its affiliation with a person or entity in connection with Hager Pilot App; or express or imply that Hager endorses any statement made by the User;
- Use the Application for purposes that are contrary to the applicable rules and that do not infringe the rights of third parties (in particular intellectual property rights, personal data and privacy rights);
- Use the Application to illegally enter an information processing system for any reason whatsoever, or to send a large number of unsolicited messages to third parties;
- Upload any Data or any data (where applicable and including usernames and passwords) the content of which is malicious, false, misleading, fraudulent, defamatory or offensive. Any breach of this clause constitutes a serious offence and may result in the deletion of such information and/or our refusal to authorise other relationships, the suspension and/or cancellation of your rights as a User of the Application, and/or possible legal proceedings with the competent authorities. In this case, the User may not make any claim of any kind against Hager arising from such suspension, cancellation or prosecution as the case may be ;
- Interfere with or disrupt the operation of Hager Pilot App or the servers or networks used to make Hager Pilot App available; or violate any requirements, procedures, policies or regulations of such networks ;
- Transmit or make available in connection with Hager Pilot App any virus, worm, Trojan horse or other harmful or invasive computer code or may or is intended to damage the operation or control the use of any hardware, software or equipment ;
- Modify, adapt, translate, reverse engineer, decompile, disassemble, circumvent, disable or interfere in any way with any part or security feature of the Application and prevent or restrict the use or copying of the content or impose any limitations on the use of the features or content accessible on the Application ;
- Remove any copyright, trademark or other proprietary rights notices from Hager Pilot App or material from Hager Pilot App;
- Frame, mirror or distribute any part of the Hager Pilot App, including the content, in whole or in part, in any other medium, without Our express prior written consent.;
- Create a database by systematically downloading and storing Application content ;
- Use any manual or automatic device in any manner whatsoever to collect the content of the Application or reproduce or circumvent the navigational structure or presentation of the Application without the prior express written consent of Hager.
With respect to the use of the Content on the Hager Pilot App, the User accepts, understands and acknowledges that :
9.5. The Application is a platform for professional Users, for the purpose of providing professional services only.
9.6. Users use all content published on the App at their own risk and voluntarily use the Services with full knowledge of the facts. They have not been induced to use the Hager Pilot App or the content by Hager or any of its affiliates.
9.7. Except as otherwise provided in these Terms, and to the maximum extent permitted by applicable law, Hager shall not be liable, directly or indirectly, for any loss or damage suffered as a result of the use or inability to use Hager Pilot App, even if caused in whole or in part by the action, inaction or negligence of Hager. In accordance with contractual and legal provisions, the User undertakes to indemnify and hold Hager harmless against any claims arising from the above provisions, regardless of their origin.
10. USER CONTENT
10.1. Account creation :
To download content from the Application, you must register as a User on your myHager account.
10.2. The User is responsible for the information provided in order to use the Application.
10.3. The User may edit his or her content using the editing functionality provided on the Application, where this is made possible by the Application.
10.4. Without prejudice to any other rights of Hager under these Terms and Conditions of use of the Application, if the User breaches any of the provisions of these Terms and Conditions in any way, or if Hager reasonably suspects a breach of these Terms and Conditions in any way, Hager may delete, remove or edit all or part of the User's content and remove the associated account or any ability to access the Application, by whatever means Hager sees fit.
10.5. Rules concerning content produced by the User:
The User warrants and confirms that such content fully complies with these terms and conditions.
In particular, the content must not be illegal, must not infringe the legal rights of any person and must not be capable of giving rise to legal action against any person (in each case, in any jurisdiction and under any applicable law).
The Content, and Hager's use of the Content in accordance with these Terms, shall not be likely to :
10.6. infringe any copyright, moral right, database right, trademark right, design right, right of substitution or other intellectual property right ;
10.7. infringe any right of confidentiality, right to privacy or right under data protection legislation ;
10.8. constitute negligent advice or contain a negligent statement ;
10.9. constitute incitement to commit a crime, instructions to commit a crime or the promotion of criminal activity ;
10.10. constitute contempt of court or violation of a court order ;
10.11. violate legislation on state secrets ;
10.12. not respecting a contractual obligation towards a person ;
10.13. explicit, graphic or gratuitous depictions of violence ;
10.14. be false, erroneous, inaccurate or misleading ;
10.15. consist of or contain instructions, advice or other information which may be acted upon and which could, if acted upon, result in illness, injury or death, or any other loss or damage ;
10.16. constitute spam ;
10.17. be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory; or
10.18. cause annoyance, inconvenience or unnecessary anxiety to any person.
11. INTELLECTUAL PROPERTY RIGHTS
11.1. As a User of the Application, the use of a feature that allows uploading and publishing Content to and/or via the Application, the User automatically grants Hager and each user, a worldwide, non-exclusive, royalty-free license to use, access, reproduce, share and redistribute the content transmitted, to reproduce, share and redistribute such Content to the extent permitted by the features of the Services and under the terms of this License (or any other applicable term) (“Your Content”). Any other applicable terms) (“Your Content License”).
11.2. The User acknowledges that Hager has no obligation to monitor the Content. Hager may choose to terminate access to the Application at any time or exercise any other available remedy and/or modify or remove any unauthorized Content, if Hager believes that Your Content provided has violated, infringes copyright or other third party rights (such as privacy or public rights), is inconsistent with the Terms or has violated the rights of Hager or another User. Notwithstanding this, as a User who publishes and makes available content via the Application, you remain solely responsible for and bear the legal risk associated with such content anywhere in the world..
11.3. As a User, you may update your Content with respect to your profile or progress page once you have published it. The License granted to your Content terminates when such Content (including all copies thereof) is permanently deleted from the Application by the User or by Hager and you are no longer a User for any reason.
11.4. With the exception of Your Content submitted to the Application by the User, all content and the selection and arrangement of such content on the Application constitutes Hager Content and is either owned by, or licensed to, Hager and is subject to the copyrights, trademark rights, and other Intellectual Property Rights of Hager and Hager's licensors. Hager makes no representations or warranties as to the validity or enforceability of any intellectual property rights subsisting in the Hager Content. All third-party trademarks or service marks contained in the Hager Content are trademarks or service marks of their respective owners. Except for the licenses expressly granted herein, neither party grants any license, right or assignment of its intellectual property rights to the Hager Content.
11.5. Hager Content, with the exception of Your Content, including, but not limited to, text, photos, graphics, trademarks, logos, icons, images, sound clips, video clips, data compilations, page layout, animations, underlying code and software are owned by or licensed to Hager, its affiliates or other applicable third parties. This material is confidential and protected by applicable intellectual property, copyright and other laws and You may not use the material on the Hager Pilot App without the prior written permission of Hager.
11.6. Hager grants Users an individual, non-exclusive, royalty-free license to use the Hager Pilot App and any associated software.
11.7. The User warrants and agrees not to, directly or indirectly, reproduce, copy, modify, rent, distribute, store, create derivative works from, reverse engineer or disassemble or attempt to locate the source code (except as required by law), sell, assign, sublicense or transfer in any manner whatsoever the rights attached to the Application or its associated software or reuse in any manner whatsoever the material in the Application, unless otherwise indicated on the Application or unless expressly authorized in writing by Hager.
11.8. Hager appreciates feedback and the User acknowledges and agrees that if the User chooses to share or submit comments, ideas or feedback regarding the operation and functionality of the Hager Pilot App, that Hager may freely use any suggestions without any restriction or compensation from the User in order to improve all or any part of the services provided by Hager and the User hereby declares that the information or feedback that the User shares or submits through the Services is not confidential or proprietary.
12. DATA PROTECTION AND USE OF PERSONAL DATA
12.1. Privacy Policy and Cookie Notice :
These Terms of Use are supplemented by the Privacy Policy and Cookie Information Notice available at : https://hagergroup.com/en/data-protection which also apply to all use of the Hager Pilot App.
12.2. Hager processes personal data in accordance with data protection legislation and our privacy and cookies policy, which can be viewed at https://hagergroup.com/en/data-protection and the terms of which are incorporated into these Terms. Hager undertakes to store personal data securely. Under no circumstances will Hager give or sell user information to third parties or organizations, with the exception of service providers contracted by Hager to provide services.
12.3. The User warrants, accepts and undertakes to comply with data protection legislation in respect of any obligations relating to its own personal data and/or the personal data of end users.
12.4. The following data is collected and processed by the Application:
- Data entered by the User. Data that Users voluntarily provide by filling in the various forms as part of their use of the Application, whether their own personal data (see clause 12.11) or data relating to third parties (see clause 12.2).
12.5. The Personal Data, identified as compulsory on the Hager Pilot App forms, that the User is required to provide in order to use the latter are necessary to be able to benefit from the corresponding functionalities of the application and, more particularly, from the operations on the content provided within the latter. They are used for the creation of the customer account, the processing of the customer relationship and of any related request, as well as for the execution of Hager Services, and may also be used for commercial prospecting purposes relating to similar products and/or services.
12.6. This data may be communicated to Hager's partners responsible for the execution, processing and management of customer relations and services for these purposes only.
12.7. Users are also informed that their Personal Data may be transferred outside the European Union. In order to guarantee an adequate level of protection, Hager has agreed with its subcontractors standard contractual clauses relating to the transfer of Personal Data to subcontractors established in third countries pursuant to Directive 95/46/EC of the European Parliament and of the Council of Europe.
12.8. With the User's prior consent, Hager reserves the right to use and communicate this information to third parties or its partners, and in particular to companies in the Hager group to which Hager belongs, as part of joint or separate marketing and sales operations, by SMS, MMS, e-mail or automated calls.
12.9. In accordance with data protection legislation, Users are hereby informed that Hager will automatically process their personal data when they use the Application.
12.10. Data collected when using the Application is stored on the Cloud provided by Microsoft Azure, in data centres located in Europe, in accordance with applicable data protection legislation.
12.11. The User is hereby informed that personal data is collected when registering for a personal myHager account, in accordance with the provisions of the Privacy Policy and the Terms of Use governing this account.
12.12. Hager is responsible for the processing of personal data relating to the User, within the meaning of the applicable data protection legislation, collected and processed as part of the User's registration with myHager.
12.13. In accordance with data protection legislation, Users have the right to access, rectify and object to their personal data. This right can be exercised by visiting https://www.hagergroup.com/GDPR-request
12.14. Third-party personal data in Hager Pilot App:
When using the Application, Users may enter personal data relating to their customers (e.g. first name, last name, e-mail address, address, etc.) in order to identify the various projects and complete their specifications. The User is solely responsible for the processing of personal data relating to all persons he/she enters in the Application. The User undertakes, warrants and undertakes to comply with the obligations incumbent upon him under the regulations on personal data. Hager is only responsible for the hosting, security and backup of this data.
13. FIREBASE ANALYTICS - GOOGLE
The Hager Pilot Application integrates the “Firebase Analytics” service provided by Google, which automatically collects and analyses certain data relating to the use of the Hager Pilot Application in order to compile statistics and improve the User's browsing experience within the application. This data may be used to identify the User: for example, to identify the most frequently used screens and their modes of use, in order to optimize performance during use. When the Hager Pilot App is first launched, the User can give his or her consent to the use of Firebase Analytics. The user can also change this selection later in the application settings. For more information on Google's data protection policy, see https://firebase.google.com/support/privacy/#firebase_is_gdpr-ready.
14. NOTIFICATION SERVICE
The Hager Pilot App integrates notification services for Users, in particular push notifications, provided by a third party (Batch) which are used to automatically collect and analyse certain data relating to the use made of the Hager Pilot App for the purpose of sending notifications to Users. When starting the Hager Pilot App for the first time, the User can give his consent to the use of this service. He/she may also modify the selection made in the application settings at a later date.
15. LINKS TO OTHER APPLICATIONS
Hager Pilot App may contain links to other applications or websites. Unless expressly stated, these sites are not under the control of Hager and Hager is not responsible for their representation or content. Hager accepts no responsibility for the content of such third party links/applications and disclaims all liability for any form of loss or damage arising from the use of the same.
16. FEES
Use of the Hager Pilot App is not invoiced by Hager.
17. LIABILITY AND LIMITATION
17.1. Nothing in this clause shall exclude or limit the liability of either party for :
17.1.1. fraudulent misrepresentations;
17.1.2. any liability where the law does not permit such exclusion of liability; and,
17.1.3. death or personal injury resulting from negligence.
17.2. Subject to the previous paragraph, Hager shall NOT be liable for breach of contract, misrepresentation by the User, or for any loss of profits, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, or costs, damages, charges or expenses, however arising.
17.3. HAGER shall NOT be liable for :
17.3.1. direct or indirect damages, losses or expenses resulting from the use of the Hager Pilot App :
17.3.2. the inability of using it, or
17.3.3. any access or use of, or inability to access or use for whatever reason, or
17.3.4. incorrect operation or interruption for maintenance reasons,
17.3.5. technical malfunctioning of the server or as a result of an interruption to the internet access, or for any other reason, or due to a virus, or a line or system problem, or a power failure.
17.3.6. reliance in the completeness and accuracy of the information provided via the Hager Pilot App or
17.3.7. any change that Hager may make to the Application in general, or any temporary or definitive deletion of the functionalities of the Hager Pilot App.
17.4. Subject to the first paragraph, Hager shall NOT be liable to the User for :
17.4.1. any breach of these Terms or a breach of warranty or acts or omissions, including the User's use or inability to use the Hager Pilot App ;
17.4.2. any reliance placed by the User on the completeness, accuracy or existence of any content (or User Content);
17.4.3. any changes that Hager may make to the Hager Pilot App, or for any permanent or temporary cessation of the provision of the Hager Services (or any functionality within the Hager Pilot App) ;
17.4.4. the deletion, corruption or inability to store User Content and other communication data retained or transmitted when using the services ;
17.4.5. the availability of third party sites or resources, or reliance on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such websites or resources; or,
17.4.6. the acts, omissions and conduct of any User in connection with, or related to, the use of the Application.
17.5. The sole and exclusive remedy in contract, tort (including negligence or breach of statutory duty, misrepresentation, or otherwise) arising from any failure by Hager to comply with its obligation set out in clause 4.2 shall be as set out in clause 4.4.
17.6. The User shall indemnify and hold Hager harmless on demand, and shall keep Hager fully and effectively indemnified against all losses suffered by Hager, or asserted against Hager, arising out of or in connection with :
17.6.1. any breach of the User's obligations (other than and to the extent that any loss results directly from the breach of these conditions) ;
17.6.2. any action or claim that any of Your Content uploaded by the User to the Hager Pilot Application infringes the intellectual property rights of any third party or is considered inappropriate content; or,
17.6.3. any complaint made by another User about you.
17.7. Hager makes no warranties and excludes all other express or implied terms, conditions and warranties to the fullest extent permitted by law, except as expressly set out in these conditions.
18. TERMINATION, CONSEQUENCES OF TERMINATION AND SURVIVAL
18.1. Termination :
Without limiting any other rights, Hager may suspend or terminate the contract with the User or revoke the User's access to the Hager Pilot App with immediate effect by giving written notice if :
18.1.1. The User commits a material breach of any of the terms of the Agreement and (if such breach is curable) fails to remedy such breach within 5 (five) days of written notice being given to the User to that effect ;
18.1.2. Hager cannot/will no longer provide services in the User's geographical area ;
18.2. Hager will inform the User by e-mail and will not be liable for any compensation for any disappointment suffered.
18.3. Consequences of termination. Termination of these Terms will not affect any rights or remedies acquired prior to termination.
18.4. Survival of certain clauses. Any provision of the contract which, expressly or by implication, is intended to come into force or remain in force on or after the date of termination shall remain in full force and effect.
19. COMMUNICATIONS
19.1. For the purposes of this document, any communication in writing includes electronic mail.
19.2. Any notice or other communication under or in connection with the contract must be in writing and may be delivered by hand or sent by prepaid post or electronic mail..
19.3. The letter or other communication is deemed to have been received :
19.3.1. if delivered by hand, on signature of a delivery receipt ;
19.3.2. if sent by post with priority postage, on the next working day, at 9 a.m. (GMT) on the second working day following dispatch; or
19.3.3. if sent by e-mail, by 9 a.m. (GMT) on the working day following transmission.
19.4. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and posted and, in the case of an e-mail, that such e-mail was sent to the recipient's specified e-mail address.
19.5. The provisions of this clause shall not apply to the service of any process or other document in connection with any legal proceedings.
20. GENERAL
20.1. ASSIGNMENT:
Hager is entitled to transfer the rights and obligations arising from this contract with full discharge. Hager will always inform the User of this eventuality and ensure that the User's rights under this contract are not affected.
The User may not transfer its rights to another party without the prior written consent of Hager.
20.2. COMPLAINTS : Hager strives to maintain the highest standards in the provision of services. Hager takes any complaints it may receive in this regard very seriously. Hager is the first point of contact for all complaints and will welcome any suggestions to improve its procedures. Hager will endeavour to resolve any disagreement quickly and efficiently.
20.3. ENFORCEABILITY: If any one or more of the provisions herein should be held to be invalid, illegal or unenforceable in any respect, the validity and enforceability of the remaining provisions contained herein shall not in any way be affected or impaired and Hager shall amend these Terms to add a new provision having an effect as near as legally permissible to the one held to be invalid, illegal or unenforceable.
20.4. ENTIRE AGREEMENT : The Conditions (which include the privacy and cookies policy) constitute the entire agreement and understanding between the User and Hager with respect to the use of the Hager Pilot application and supersede all prior agreements, understandings and arrangements with respect to the matters set forth herein. The User acknowledges that it has not relied on any oral or written representations made by Hager in accepting these Terms, irrevocably and unconditionally waives any right it may have to rescind these Terms or to claim damages for misrepresentation, whether innocent or negligent, or for breach of any warranty not contained herein or implied by operation of law.
20.5. FORCE MAJEURE : Hager reserves the right to cancel or revoke the supply of any of the services, without liability, if it is prevented or delayed from carrying out its activities by an event of force majeure.
20.6. SEVERABILITY: Each of the Terms in here operate separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining Terms will remain in full force and effect.
20.7. INDEPENDENCE : These Terms are not intended to create any partnership or joint venture relationship between the User and Hager or authorise any party to act as agent for the other party, and no party shall have the authority to act in the name of, or on behalf of, or otherwise to bind the other party in any way (including, but not limited to, the making of any representation or warranty, the assumption of any obligation or liability and the exercise of any right or power).
20.8. THIRD PARTIES : These Terms are not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms.
20.9. NO WAIVER : Failure by either HAGER to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.
21. LAW AND JURISDICTION
These terms and conditions shall be governed by and construed in accordance with French law. The exclusive place of jurisdiction for all disputes arising from these Specific Terms and Conditions of Use, including disputes relating to their validity, shall be, to the extent permitted by law, Strasbourg (France - 67), even in the event of multiple defendants. If the User is considered to be a consumer and has his habitual residence in the EU, he shall also benefit from the protection afforded to him by the mandatory provisions of the law of his country of residence.

This patent license shall apply to the combination of the Contribution and the Program if, at the time the Contribution is added by the Contributor, such addition of the Contribution causes such combination to be covered by the Licensed Patents. The patent license shall not apply to any other combinations which include the Contribution. No hardware per se is licensed hereunder.
c) Recipient understands that although each Contributor grants the licenses to its Contributions set forth herein, no assurances are provided by any Contributor that the Program does not infringe the patent or other intellectual property rights of any other entity. Each Contributor disclaims any liability to Recipient for claims brought by any other entity based on infringement of intellectual property rights or otherwise. 3.1 If a Contributor Distributes the Program in any form, then:
a) the Program must also be made available as Source Code, in accordance with section 3.2, and the Contributor must accompany the Program with a statement that the Source Code for the Program is available under this Agreement, and informs Recipients how to obtain it in a reasonable manner on or through a medium customarily used for software exchange; and
b) the Contributor may Distribute the Program under a license different than this Agreement, provided that such license: i) effectively disclaims on behalf of all other Contributors all warranties and conditions, express and implied, including warranties or conditions of title and non-infringement, and implied warranties or conditions of merchantability and fitness for a particular purpose;

3.2 When the Program is Distributed as Source Code:

4. COMMERCIAL DISTRIBUTION

If Recipient institutes patent litigation against any entity (including a cross-claim or counterclaim in a lawsuit) alleging that the Program itself (excluding combinations of the Program with other software or hardware) infringes such Recipient's patent(s), then such Recipient's rights granted under Section 2(b) shall terminate as of the date such litigation is filed.
All Recipient's rights under this Agreement shall terminate if it fails to comply with any of the material terms or conditions of this Agreement and does not cure such failure in a reasonable period of time after becoming aware of such noncompliance. If all Recipient's rights under this Agreement terminate, Recipient agrees to cease use and distribution of the Program as soon as reasonably practicable. However, Recipient's obligations under this Agreement and any licenses granted by Recipient relating to the Program shall continue and survive.
Everyone is permitted to copy and distribute copies of this Agreement, but in order to avoid inconsistency the Agreement is copyrighted and may only be modified in the following manner. The Agreement Steward reserves the right to publish new versions (including revisions) of this Agreement from time to time.
